6. Reservation Requests, Rates and Booking Terms

6.1 Nature of Reservation Requests

Any reservation request or enquiry submitted through the Site constitutes an expression of interest and does not in itself constitute a confirmed booking or a legally binding reservation. A reservation becomes binding only when we issue a written confirmation of booking to you, whether by email or other documented means.

6.2 Rates and Pricing

All rates and prices displayed on the Site are expressed in New Zealand dollars (NZD) and are inclusive of GST at the current applicable rate unless otherwise stated. Rates are subject to availability and may change at any time without prior notice until a booking is confirmed in writing.

6.3 Accuracy of Rates

We make every reasonable effort to ensure that rates and availability information displayed on the Site are accurate at the time of publication. In the event of an obvious error (such as a manifestly incorrect price), we reserve the right to withdraw or correct the rate prior to confirming any booking. We will notify you promptly of any such error and offer you the option to proceed at the correct rate or to withdraw your request without penalty.

6.4 Cancellation and Modification

Specific cancellation, modification and no-show terms will be communicated at the time of booking confirmation and shall form part of the binding contract between you and . 6.6 Guest Obligations

Guests are required to comply with the Hotel's House Rules and any applicable policies during their stay. The Hotel reserves the right to refuse or terminate a stay without refund in circumstances where a guest's behaviour is disruptive, unlawful or in breach of the House Rules. A copy of the House Rules is available upon request and is provided at check-in.

7. Age Restrictions

7.1 Casino Facilities

In accordance with the Gambling Act 2003 (NZ) and all applicable New Zealand regulations, access to casino gaming facilities at Feravellian Prestige Hall is strictly restricted to persons who are aged 18 years or older. We operate a rigorous age-verification policy. Any person who is, or who appears to be, under the age of 18 will be required to produce satisfactory proof of age before being permitted to enter or remain in the casino gaming area. We reserve the right to refuse entry to or remove from the casino area any person who is unable or unwilling to provide acceptable proof of age.

7.2 Hotel Accommodation

Age requirements for hotel accommodation and other non-gaming facilities are set out in the applicable booking terms and House Rules and may differ from the casino age restriction above.

7.3 Use of the Site by Minors

This Site is not directed at persons under the age of 18. We do not knowingly collect personal information from individuals under 18. If you are under 18, you must not use this Site or submit any personal information through it.

Subject to Section 11.2 above, in no event shall we be liable for any indirect, special, incidental, consequential or punitive loss or damage (including but not limited to loss of profits, loss of revenue, loss of data or loss of business opportunity) arising from your use of the Site, even if we have been advised of the possibility of such loss or damage.

Where we process special-category personal data, we do so only to the extent necessary and in accordance with the Privacy Act 2020 (NZ) and any other applicable legal requirements.

You agree to notify us immediately if you become aware of any unauthorised use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this obligation.

The courts of New Zealand shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the use of the Site, subject to the dispute resolution process set out in Section 15 below.

For consumer-related disputes, you may seek assistance from the Commerce Commission or the Disputes Tribunal, as appropriate.

15.4 Mediation

Before commencing formal legal proceedings, both parties agree to act in good faith and to attempt to resolve any dispute through mediation administered by a mutually agreed mediator in New Zealand, provided that either party may seek urgent interlocutory or injunctive relief from a New Zealand court where necessary to protect its rights.

16. General Provisions

16.1 Entire Agreement

These Terms of Use, together with our Privacy Policy and any written booking confirmation issued by us, constitute the entire agreement between you and with respect to your use of the Site and supersede all prior agreements, representations and understandings relating to the same subject matter.

16.2 Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

16.3 Waiver

No failure or delay by us in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver of any breach of these Terms shall not constitute a waiver of any subsequent breach.

16.4 Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to any successor entity or in connection with any merger, acquisition or sale of assets, provided that such assignment does not materially prejudice your rights.

16.5 No Third-Party Rights

These Terms do not confer any rights on any third party. The Contract and Commercial Law Act 2017 (NZ) shall not apply to create rights in favour of any person who is not a party to these Terms.

16.6 Language

These Terms are written in English. In the event of any inconsistency between this English version and any translation, the English version shall prevail.
